There is such a simple answer to the broccoli question:

"Put simply, there is nothing inevitable about the individual consumer and broccoli. Millions may go their whole lives and never touch it. Whether they should or not is not a mandate for the federal government to impose.

However, it is inevitable that everyone will be in the market for food, whose quality is regulated by the federal government. And it is inevitable that everyone will be in the healthcare system at some point, if not regularly. That treat will almost inevitably involve either national insurance companies and/or federal government medical care payments.

Therefore the shape of the healthcare system and market becomes a compelling federal interest."
