in addition to the fact the the individual mandate isn't a tax, it wouldn't fall withing the constitutional limits for the American federal government if it was a tax. But that point doesn't matter too much since its a mandate not a tax.

I'm finding the irony amusing. They could have made it a tax but they were so keen on not using the "t" word that they hoisted themselves they their own proverbial petard. The simple fix, I suppose, would be to make it a tax.
