I believe that's what I have stated. At least, it was my intent.

So, every state could implement an individual mandate if the legislature implements the appropriate laws. Amendments are just a part of the legislative process.

It seems misworded. What is "nor" there for? Would it correctly be "or"?

The not nor seems to create a double negative. We should amend the 10th Amendment. <g>

The by it is clearly by THE CONSTITUTION.

The decision will not be over the first part, which is clear, but over the second part,

"nor prohibited by it to the States".
and comparing that to a theoretical wording of
or prohibited by it to the States
