I believe they would consider that the same as selling and buying right back.
There's some sort of wording in the rules that essentially covers that scenario.

Capital losses may not be used to offset gains or income if you sell a security at a LOSS and PURCHASE the SAME security within 30 days BEFORE or AFTER the trade date establishing the loss.

The sale at a loss and the repurchase within a 61 day period is a WASH SALE.
