well at least i understand why i am not able to get any preferred cheap. i have been looking at 5-6 times common as being a reasonable premium, but with this potential arb thing, who would be willing to see to me at that level? :-(

But, would this arb play apply to those that have bought the preferred after the BK filing? My tender offer is through Fidelity and I owned them prior to the BK. Haven't heard anybody replying that they received the offer after purchasing theirs post the BK filing!

Ahh...I was late on seeing that news on the conversion change. Good decision on management part. Get the preferred class to downsize itself and head to the trash bin. Less preferred to deal with. Once it settles down it will make the preferred class more attractive being smaller.
