The only surprise I had about Mirant is when they threw shareholders under the bus at the 11th hour and then backed over them twice. There was no doubt in my mind they had assets that covered the equity. Im not as confident about ATPs bond recovery. The shareholder committee if approved will need to make sure their lawyers push the judge to make sure max wells are drilled and max oil flows per financing agreements and reserves and infrastructure assets are fairly valued. Even assets like Israel and Uk really need to be pushed on value as much as the company and bondholders have put them on the back shelf. The shareholder committee may fail in the end but they will definitely help 2nd lien holders.
