Dan, is the problem the unions or management who do not have the skills to cope with the unions. I am amazed having worked as management in the private and education sectors, and having taught both at the universities, the lack of skills of management to either keep the unions out, or not knowing how to bargain with the unions or handle crisis. As in buying a car, just as an union organizer, I went for the best deal I could get for members.

However, I was amazed how unskilled some management negotiators were when they gave up some of the bargaining items that the union would have given up. Bargaining on the management and union side of the table requires the negotiators must have the skills, plus know "when to hold them and when to fold them."

An example if the area of "management rights clauses." From the union side of the table I tried to get the management to include the contract language, federal, state laws, and regulations, and constitution if management was foolish enough to include such language into the contracts. Some management negotiators were that foolish, some were not.

Whatever the language was, with a strong grievance, dispute procedure (mediation, fact finding, and/or arbitration) and then the right to the courts, plus the book on various arbitrators the union with its language in the contract, normally, had management on the defensive.
