I've never dealt with McDs but I would guess not. I think in the case of McDs, you would have to be a franchisee to purchase any of the branded merchandise.

But if you aren't branding yourself as McDs, you probably could buy most everything cheaper elsewhere, I suspect.

Being a franchisee doesn't automatically put you within the purview of the health care law, however. If you're individually owned, it would be the number of employees your organization (presumably a small corporation) has.

The problem is that a McDs requires enough employees that a second store becomes a problem. I believe the "common control" laws from the tax code apply, which means there is no escaping the problem by setting up different corporations.
