ATPG may not win anything from BP, but it wil not be for lack of resources to litigate. There are many attorneys who will take a case like this on a contingency basis. The Tobacco companies had much more resources than the smokers but that made no difference once contingency fee attorneys became involved.

Exxon decided to litigate everything, deny, and it cost them dearly in court awards, public opinion and share price
Short-term it may have cost them dearly, but long-term it was a brilliant move. Back in 1994 Exxon was ordered to pay about $5 bln in damages. They continued to fight it tooth and nail. Fifteen years later (2009) they finally owned up to paying about $500 mln.

Exxon got over big time and BP would have been wise to do the same. Big oil companies are already hated so who cares about short-term PR hits?
