If they shorted at $4.5 now, and then cover with shares they bought at $3.40 one year from now, that is close to a 30% gain on their money. And that is guaranteed! Sure, they are giving up the potential of making a lot more if the stock goes above $4.5.

But it is hard to find a guaranteed 30% return on your money. Not only that, but they got warrants to buy more stock at $4.40 to boot.

That's the way I look at it.

Hey you are missing the point!!! This is a risk free arb for the swiss people!!! They know they are going to buy the stock at 3.4 so any sale above that is a gauranteed profit. Who cares if they have to hold it for 3 years . Doesn't matter. Only thing one needs to look at is the cost to carry long stock vs short stock. My guess is that is about .5%, or 2 cents for the next year. Where can I sign up for this deal??? Anyone would jump on an opportunity like they had!!! SPEEDY================================================================

TexasDude, I think Betty pointed it out perfectly. They have a "risk free" 30% return on their money. They probably already own a lot of JMAR and this is kind of a bonus transaction for them. Shorting against the box, or stock you own. I would do it myself and keep my long-term shares separately. How many people do you know that would take 30% risk free? This is a short-term aberration that caused the stock to tank temporarily. This could be an exceptional buying opportunity. But the cap is off now and stock could rise at any time. I think the company realized this when they saw the short position and came out with news prior to the Equity conference, otherwise the cap on the stock would still be on. Good times ahead should come for JMAR invesors.
