[Off-topic] I see a successful lawsuit in these last-minute broker downgrade.

I can see a broker sending a customer a history of their upgrades/downgrades, customer deciding to rely on broker recommendations (or have the broker manage their account) on the basis of their history, then later finding out that broker made downgrades in the morning before big drops, claiming in their literature that they downgraded at the previous day's closing price. Customer loses money, as broker is distant relative of Wrong-Way Corrigan.

Customer sues broker, wins - easily.
