Except that it does matter. It matters on many levels but all we have agreed to is that the outcome should be "just" meaning, resolute and reconciliatory. It fails.

You can not because "life" violates the fundamental tenets of justice. Fail.

intelligent and humane point of view...
What if the murderer believes he deserves the death penalty.

The bible says an eye for an eye.

What if the country can't afford to keep everyone locked up indefinitely.

What about toughening up sentences on pot convictions.

Do you ever watch The First 48 on TV? It is, IMO, the most important show on television. You might find it enlightening.

I'm really not against the death penaly, only because it does serve to reduce the population of humans on this planet, plus, it takes some really dangerous characters out of society. I see overpopulation as the root cause of many of our most serious problems, and anything that serves to reduce overpopulation, like the death penalty and abortion, as good things.

I can see that ideally, you don't want the state to kill anyone, ever. But that doesn't address reality.
