Military action is not a declaration of war. The President is within Constitutional limits to deploy operations and actions without the consent of Congress. Congress hasn't declared war since 1942.

This grey area, which presidents take advantage of, has circumvented Congressional Declarations since 1942. I would like to see some clarification on what constitutes an act of war, then see a provision that limits the President's actions in that regard, but at this point he could bomb Iraq without a declaration of war. BTW congress approved the invasion of Iraq without declaring war.
