the first ruling was 2-1...opposed

the second was 3-0..for

adding them up...gives

4-2..for ACA.....

Understand--I'm thinking it will only matter ultimately what the SCOTUS says about it--and the fact that the two appellate courts disagree (so far) only increases the likelihood that they will take the case.
