He had the right to get away with a gun, so I suppose the answer is "yes".

Utah allows unlicensed open carry of a firearm that is at least 2 actions from firing. For example, a semi-auto may have a full mag but the chamber must be empty. Permit holder may open carry as well, but their firearms may be fully loaded.

This is not what I would expect to see coming out of Utah. The community doesn't sound very racist...93% white and electing a black mayor.

What worries me is that this will be a story like the black man carrying a BB gun in Walmart and some 'concerned' citizen phoned it in to police as waving a gun around.
