Dear Harvey:

I was in the interconnect business. When an electronic switch maker develops a new piece of software to control their switch do they have to get permission from the DOJ; do they have to run it by their competitors? No as long as it does not disrupt the system as a whole they simply sell it as an improvement to the switch thereby providing more convenient access to the voice net.

The Ma Bell telephones were hardwired to the system and there were no jacks thereby barring access to the analog net. The wire was an absolute barrier plus the fact that the Bells would not let you own the phone. There is no comparison here. The modem is tethered to the net via the same RJ's as the phones.One can choose to use Navigator with any OS they would like to use it with including Windows and many do. The same holds for IE. There is no physical reason or contractual language that says I cannot own whatever connecting device I would like to access the net. The judge slapped MSFT's wrist for strong arming the OEM's but there really is nothing more to be said after that. If the intergration of the web access to OS is such an unfair advantage should the concept be outlawed foor all?

If so perhaps GM should tear out the engines and ship them with the body to the dealers a la carte even though the customer would prefer a factory assembled product. Or perhaps the customer should be allowed by DOJ to insist that a Ford engine be mounted in that Jeep they are buying.

If you see that our courts are headed in this direction then judges really don't understand the basic functionality of an OS or the market place for that matter.

You guys are bonkers.
