Its not clear if it is legal or not, typically the CEO and other officers have to file to sell shares several months in advance of the actual sell date. It is not clear that he did this for this last sale.

He did file the necessary SEC Form 4, which is filed immediately upon the sale and is published widely you can see insider sales for any stock including GTAT here:

In any case the sale is a huge red flag that will draw many legal lawsuits, you can even see some of them listed in the news links at the link above.
