You didn't address this part of my post: How about a captured member of a terror group which has a dirty bomb in your city? No one touches him and he gets a lawyer to see rights are protected. Then the dirty bomb goes off and kills ten thousand people in your home city. You survive but your family all dies. You will be thankful the captured terrorist got his rights protected, right? OTOH If you find out that someone deprived him of sleep, scared him, or whatever, you will be outraged at that. When those 3 terrorists were "tortured" 3000 Americans had been killed by their fellow terrorists and more attacks were threatened. It's easy for you to judge them because you feel safe with no worries. Partly because of a lot of people worked hard and did everything they could think of to keep you safe.
