The SecState is a classification authority. As such, she had a duty to treat classified information with utmost care, including proper marking, and secure storage and handling.

I'm doubtful anyone on this thread has a real command of the law surrounding this issue.

But it is evident this woman lacks the judgment necessary to be president. No way.

The 150 emails were classified after the fact because they were found to contain confidential information. Hillary can state with certainty they had not been marked as classified. She can not state convincingly that she did not know there was confidential information in them. But we cannot prove she did not know there was confidential information in them or we could hold her liable.

Of course her emails couldn't be marked classified before she created them so it is something of a loop hole anyway.
