No. I will defend myself if necessary. If he is a danger to society what the hell is he doing OUT of the mental institution? Would you deny other fundamental, Constitutional rights to him for being sick, or only the Second Amendment rights? Who decides whether a particular illness warrants banning gun rights and for how long?

I don't trust government to perform that function. I have known severely mentally ill people who opened guns all their lives and never killed anyone.

I think your post exemplifies the problem. A dangerous person is dangerous with or without the right to buy a gun. The idea that he would be turned on the street with a mere prohibition on gun ownership is pretty stupid, do you not agree?

Federal law already requires background checks for all guns sold by licensed firearms dealers.

There's no "gun show loophole." There is a loophole for private transfers (like when my Dad died and Mom sold a gun to a neighbor because no one in the family wanted it - btw if member of the family had taken the gun that would be a private transfer too). Any laws limiting those kind of private sales, inheritances, and gifts would be unenforceable.

The background checks don't seem to work. Determined people can get guns.

Here's who the federal background is supposed to keep from buying a gun:

A prohibited person is one who:

  • Has been convicted in any court of a crime punishable by imprisonment for a term exceeding one year;
  • Is under indictment for a crime punishable by imprisonment for a term exceeding one year;
  • Is a fugitive from justice;
  • Is an unlawful user of or addicted to any controlled substance;


[ bentway and rat have claimed to be regular users of illegal substances, yet they own guns. Koan lives in AK and regularly sees bears in his neighborhood, so I'll bet he owns a gun yet he recently returned to SI saying he'd spent 7 months lying stoned on his couch learning about the Asian mind via South Korean soap operas .... I'm not going to report these guys to the FBI, are you? Do you think they're public dangers who should be reported? ]



  • Has been adjudicated as a mental defective or committed to a mental institution;

[ Adjudicated is an important term. People voluntarily submitting to psychological treatment aren't adjudicated. There's also a HIPAA problem with even identifying these people. ]

  • Is illegally or unlawfully in the United States;


[ Like the guy who shot Kate Steinle ... he even stole the gun from a locked car. The felons Obama is letting stay in the country .... lots of them are armed. ]

  • Has been discharged from the Armed Forces under dishonorable conditions;

  • Having been a citizen of the United States, has renounced U.S. citizenship;
  • Is subject to a court order that restrains the person from harassing, stalking, or threatening an intimate partner or child of such intimate partner;
  • Has been convicted in any court of a misdemeanor crime of domestic violence. [7]
