Iomega Corp [NYSE:IOM] and Nomai S.A./Nomai U.S.A. left court Friday with orders that Nomai still may not sell its XHD Zip-drive-style cartridge in the US. But Iomega didn't get its way either, since the injunction against Nomai was not made permanent as it had requested. At issue was the ability of Nomai to market and sell its lower- priced, 100 MB (megabyte) version of the Iomega Zip drive cartridge. Nomai wanted to claim compatibility between the two products while Iomega was fighting to block that claim. Eventually the court will have to issue a decision on that conflict. A source at Iomega told Newsbytes: "Nomai's request to have the temporary restraining order lifted was not granted," but rather was taken under submission. Iomega's request to have the preliminary injunction put in place was taken under submission but not granted either, the source said. He said Nomai lawyers submitted a large number of documents to the court on Thursday and the court is giving Iomega lawyers additional time to review the documents and respond. Iomega must review the documents and meet with the judge in the Oakland court on January 7 to submit additional information to the court. The two firms have battled this issue in courts all over the world, including France, Nomai's home country, Germany and the United Kingdom, beside the United States. The French injunction was lifted last week, but the other decisions are still pending. Iomega continues their allegations that Nomai violated patent rights to Iomega Zip drive technology and will evaluate the information for argument when the firm returns to court next month. Nomai remains unreachable by phone for comment on the outcome of Friday's decision.
