Ed I don't believe you're being too negative as much as you are stateing the cold hard facts about shivering Shiva. You're right the stock could trade closer to book. I needed to blow off some steam. I remember when March 30 97 brought us a preanouncement of bad numbers acomin will DEc 30 be more of the same? I am amazed at how the stock knows ahead of time about bad ink flowing soon to a theatre near you!!!! Or maybe capitualation is spreading without additional bad earnings. A takeover at 3 times sales would actually put the stock at 18 --- 19.5 that is not unusual. But you are right who really needs them other than Cabletron. By the way LUCENT payed 5or 6 times sales for Livingston. Its time Mike Feinstein Longmeadows brightest and former Shivaite came on-line and gave us some insite into when Shiva will turn it around !

Ed,

If you still want to own the stock, you can sell it and then buy it back within 30 days. If you are afraid the stock will make a sharp up move in January (don't hold your breath), you can buy Call options.

I assume you meant after 30 days...........

As I understand it, if you are planning to sell the common for a tax loss, you cannot buy the CALL options during the 30 day waiting period without getting yourself into the mess of the wash sale rule. Net, you cannot take the tax loss because you bought the derivative within the 30 waiting period.

Ben A.

PS Not intended as Tax Advice, opinion only, do your own investigation of the 'Wash Sale' rule.

<<<In conclusion, before accusing me of being too negative, take a good
look at Shiva's chart. Is there anything to get excited about? Shiva
is in a bear market with occasional corrections to the upside.>>>

For last month, can you point out any high tech stocks have a
good looking chart?

IMO, smart money already sold for the tax loss and is going
to jump back in before the year over. For the last few weeks,
money has flown out of stock funds.
