the answer is yes. 5 bucks is a requirement.It is the only impediment right now.all other needs are met as of today.

Chris, I talked to NASDAQ a month or so back in regards to the 5 dollar level. They prefer to see a company stay above 5 for a month before applying and throughout the entire application process. However, this is not the only acceptable scenario. The price does not HAVE to be above 5 when the application is filed. If there are mitigating factors, it is possible that a stock is only above 5 for a short period of time during the process. There is a great deal of discretion that can be exercised. Will it be? There is no way to know. When the price goes over 5, we should wait 2 weeks and then file. During the process, about 4 weeks, I know that I and everyone who cares for this stock, including, hopefully, those guys who have invested 7 Million dollars recently, will do whatever we can to make sure the stock stays above 5. Once the application process begins, we would probably have to fall below for a week, in order to have to re-start the clock. It could get ugly to keep the price up, if the MM's decide to really do a number on it, but that's war.
