My only problem with that is that when you let individual owners decide no one wants to go first, so everyone allows smoking. The restaurants I worked in had non-smoking sections but that was meaningless. The air was full of smoke everywhere. And it was awful. Now you could argue that the non-smoking diners didn't HAVE to eat out, but why? They aren't engaging in any activity, except dining, which is afterall what restaurants are for. Smokers, on the other hand, are actively doing something that is superfluous to the dining experience. I find dancing on the table naked after a meal, makes dining much more enjoyable, but I'm not allowed to do that at restaurants (at least not the kind I want to go to.)

Holly, I'm a non smoker and have been for 13 years but I totally agree with you. Freedoms never get eroded all at once, but little by little so it's not as noticeable.

I don't like cologne either but I'm not about to pass a law outlawing it.

Then there is the issue of enforcement. What if I did smoke in a non smoking bar. Are they going to kick me out? Throw me in jail? Laws should be enforceable. Does anyone know what the punishment is for someone smoking in a California bar or restaurant now? Guess what there isn't one. And your civil rights prevent them from throwing you out.

A business person should have the right to allow smoking or not. Let the free market decide. If smoking bothers you so much so that you can't work there. Don't. It's as simple as that.

Most people don't realize this, but since the law was passed to ban smoking on airlines the airlines now do not refresh the air like they used to. So although you think the air is cleaner it may not be.

This whole smoking ban issue is just another clever way for a bunch of lawyers to make a bunch of money by suing people, or by defending them in a suit.

What's next...ban Fats in foods, ban alcohol, or better yet how about banning cars?? after all there the real killers.

My prediction....within 3 years a new law will be passed in California rescinding the ban.
