While it is true that Congress (and Staff) purchase ACA policies on the exchange, what is WAY different is that despite their good incomes, they still get federal subsidies that pay for most their policies, and they all get gold policies. Their subsidies are NOT per the ACA rules, but instead come along as a result of their prior subsidized healthcare from before the ACA.

So are they on ACA or not? Answer: Not really because their subsidy structure is outside the ACA and WAY more generous.
