I'm curious, Eugene. I see you are in Redmond, Washington, but you are a Doctor of Chiropractic. Are you a Microsoft employee, or a chiropractor who happens to to be in Redmond, or both?

If you practice, can I ask if you get a lot of visits from higher-ups at MSFT?

Or, is the DC a humorous take on 'spin doctor'? Just kidding, of course! ;-)

Well, Gene, disgusting is as disgusting does. So, you find a random email an "incredible joke"? Want to know where it came from?

But with Lessig's email now coming to light, the government may have a harder time explaining Lessig's sentiments regarding Microsoft. A government official said the Justice Department collected it in the course of its investigation. "Once we came across it, we felt duty-bound to present it to the court and to Microsoft," said the official, who asked not to be named. Just the kind of thing you'd expect the ethical, courteous, humorous legal eagles at Microsoft to do, isn't it? Instead, it was those nefarious market crashers at DOJ who spilt the beans. As for what I think is disgusting, I've posted this before, and I'll do it again: news.com . Wanna take the challenge and respond to that one? I'm not holding my breath.

Lessig may or may not stay on the case; like I said, my perspective is that anybody who hasn't gotten intensely annoyed after installing some Microsoft product or other is leading a very charmed life. If you're running IE4, you should try installing IE3, it's supposed to be good for a laugh.

My views on Lessig are well documented on this thread and have not changed. All I was pointing out was that, like the OEM deposition testmony about Microsoft not allowing them to remove the icon from the desktop, I do not think this letter is necessarily as much of a smoking gun as everyone seems to think it is. Your interpretation may turn out to be the correct one, and, even if it were not, that fact would not establish that Lessig loves Microsoft. I prefer to reserve judgment on the e-mail until we see what Lessig, DOJ and Microsoft all have to say about it.

In any event, it does not matter what I think or what you think. What matters is what Judge Jackson and, ultimately, the Court of Appeals think. It is to this audience that Microsoft has to prove its case, and I'm just saying the e-mail may prove less than it appears to.
