Jim,

I forgot the guys name also, however, he had been predicting a major bear market for the last 3 or 4 years also before turning bullish recently. I don't believe the street has ever taken this guy seriously. CNBC brings him on as a contrarian (and a joke).

To really state that a H/S formation is in place requires confirmation. In the case of the DOW that means closing a few % above the neckline which looks like about 8150. It's not even close to that and getting farther away by the minute.
