I don't know if it is strategic or what, but I do not believe it is just Rudy being stupid. That's not his history.

Speaking of history, I haven't yet seen anyone ask Rudy why his position flipped from Bill Clinton's time. Perhaps just being a lawyer arguing whichever side of the question he's on at the time rather than conviction or expertise.

As for strategy, I don't expect that it's a legal one but rather proselytizing.

I'm not sure -- based on the information we have -- that the requisite intent was or wasn't there.

Seems to me that showing up at a meeting with a given purpose shows intent wrt that purpose.

Criminal intent is not a prerequisite for many crimes. As any judge will tell you, "ignorance of the law is no excuse".
