Legally, you certainly can. You just shouldn't and most people don't.

As you just suggested there are things that should not be said because it makes no sense to say them. But some people will say them anyway.

Don't you think that the fool who yell fire in a crowded theater and cause some deaths, should be judged and sentenced.

In other words, if you say something that do seriously harm other people, should'nt there be some rules to let you know what consequences you may get?

BTW, if I was american, I would not be a republican nor a democrat.

BTW2, are you a libertarian or a republican?

Theoretically, our elected people work for us, but in recent
decades they brazenly defy that founding principle, and
seek to impose their will on us. Whether it's for power, money
or fame it's wholly unacceptable and unAmerican.
There is no indication that the political class is more useful,
intelligent or productive than any other class of Americans.
But politicians want you to believe it, and that's why Trump's
election is so dangerous to them.
