That's for Congress, and specifically the House, to decide. The president doesn't have the right to overrule that decision.

No; the Constitution doesn't say "Your free speech has to be listened to", nor "Individuals can't pass laws abridging", so it can't be unConstitutional. There are state and local laws, however, against punching anybody wearing anything for any reason, so it is considered a crime. You have my permission to arrest the suspects.
