...The "I" word--impeachment--is already in the air. Absent more conclusive evidence, we're not climbing on that bandwagon. But, in a purely legal and constitutional sense, such talk is appropriate. Under the Constitution, a congressional investigation is the preferred venue for airing allegations of serious misconduct by the president--and for deciding if they warrant his removal from office. Such an investigation, although inevitably partisan, would certainly be preferable to leaving the decision to an unelected and hence unaccountable independent counsel. We, however, doubt that the
Republicans would have the courage to mount such an inquiry. Why should they? Ken Starr is already quite effectively damaging the president, and the president is already quite effectively damaging himself.
