It also ignores the fact that Trump has already been impeached. While he was in office. The Constitution does mandate that the Senate must try an impeachment once it occurs. There is nothing about the president being in office at that time. At best it is a gray area. However, did the framers really intend there be a loophole for someone to resign before the impeachment trial to render it moot? That might be reasonable if the vote to convict only allowed removal from office as the only penalty. But it doesn't.
