You're confused John. Maybe hearing thundering gavels in your head is a symptom of schizophrenia. There are some good drugs for that, you know. It's a procedural ruling, the appeal was consolidated. I'm sure Reggie will weigh in sometime about how Lessig has really been busted for conspiring to sue Microsoft now, but I didn't read anything like that in the story, except of course from the Microsoft spokesguy.

And, again, it's not like it matters that much. The appeals panel will rule what they rule, when the time comes. Given the composition, Microsoft will likely do ok. If this gavel was like thunder to you, you better get some good earplugs. I'd say it's more like the serial killer will walk again on a technicality, to paraphrase Harvey Allen. There are numerous other actions and investigations in the works.
