They may not be able to pick ANYONE with Senate Judiciary tied in membership at 11d and 11R. One of the Rs would have to defect and there certainly are Republicans on the committee that would but they could hold Biden's pick until the mid-terms.

That means that if Kamala steps down as VP to join SCOTUS, the Democrats would no longer control the Senate

They are likely to lose that edge next January anyway, so it might be worth it to get rid of her. I read that she can even legally cast the 51st vote on her nomination.
