TXB and Zonagen will not sue because it will cost more to go to court then the amount awarded as general damages. There is no big pockets to go after. SI may be liable but its hard to say since many state statues add more freedom of speech protection to the media than provided by the Constitution of the United States.

I would have to check the Texas statutes to be sure but usually, a higher fault standard is applied where Corporations are suing for defamation. In many states, corporations are analogous to public figures which means that TXB and Zonagen would need establish "malice" on the part of SI and Bill Wexler.

TXB and Zonagen are legitimate and the FDA will attest to this in the future. When the FDA speaks, we will know the truth. A favorable court ruling wouldn't do justice. Let us wait...
