Not just genes, but living, reproductive organisms. Dr. David Martin has a lot to say about that. His argument boils down to a simple choice - it's illegal or it's illegal.

Either it's illegal to patent an organism that exists in nature due to US patent law

or

It's not an organism that is naturally occurring and it's illegal (in the case of some of these pathogenic viruses) due to international treaties (and US law regarding such treaties) barring development of such dangerous potential bioweapon threats.

The US govt has issued these patents and the CDC has had some of them removed from inspection at the patent office. The whole thing is very fishy, and now it is surfacing in Ukraine and Georgia and coming to a biolab near you!
