RE: Iomega Comments on the Nomai Injunction.biz.yahoo.com Friday February 13, 6:51 pm Eastern Time Company Press ReleaseCalifornia Court Rules on First Motion for a Preliminary Injunction in Ongoing U.S. Litigation Between Iomega and Nomai Hearing on Motion for Preliminary Injunction Based on Copyright and Patent Infringement Set for Feb. 27 ROY, Utah--(BUSINESS WIRE)--Feb. 13, 1998-- Iomega Corp. (NYSE:IOM - news) announced that on Feb. 11, 1998 the United States District Court for the Northern District of California partially granted and partially denied Iomega's motion for a preliminary injunction against Nomai, S.A. Under the new ruling, Nomai is prohibited from advertising its XHD disks as being compatible with Iomega Zip drives without expressly warning customers that the disks are not compatible with notebook Zip drives. For procedural reasons, which Iomega believes were incorrectly decided, the court did not consider independent laboratory tests conducted in January 1998 demonstrating that XHD disks are not compatible with desktop Zip drives. These tests showed that a significant percentage of desktop Zip drives tested at room temperature with XHD disks exhibited catastrophic head damage creating a serious risk for customers of unrecoverable data loss. Iomega's motion for a preliminary injunction preventing the sale in the United States of XHD disks based on claims of copyright and patent infringement is still pending. The hearing on this motion is set for Feb. 27, 1998. ''Iomega cares about protecting its customers and the information they rely on to do their jobs and manage their lives,'' said Kim B. Edwards, Iomega's president and chief executive officer. ''We are pleased that the legal action we took in the United States was successful in preventing Nomai from coming to market with advertising that was clearly false and deceptive, but we are disappointed that the court did not consider the independent test results we submitted in January demonstrating that customers will put their valuable data at risk when using XHD cartridges.'' Customer research indicates that more than half of Iomega's customers use Zip disks to transport data between machines, for example to transport files from work to home. It's very important for Zip users to have disks that work with all current and future Zip drives. including notebook drives. Iomega has spent years developing innovations that ensure its customers can use their genuine Zip 100 disks reliably and seamlessly with all Zip drives including Zip notebook and desktop drives. The company has been particularly vigilant in ensuring that both Iomega and its authorized partners Fuji and Maxell sell high quality disks that maximize performance of Iomega's Zip system. ''We tested our genuine Zip 100 disks under all of the same conditions as the Nomai XHD disks and they exhibited 100% compatibility,'' added Edwards. ''We believe it is our responsibility to warn our customers that independent testing conducted at room temperature showed a significant percentage of desktop Zip drives tested with XHD disks were permanently ruined. We think that makes them incompatible with Zip drives -- period.'' Iomega Corp. manufactures personal read/write storage solutions that help people manage their stuff-anywhere.
