For sure SIMO should get the break up fee. But I wonder if SIMO might end up owning MXL if the arbitration court winds up determining MXL breached the contract, and therefore must move forward with the contract, but MXL can't (at that time) raise the $3 billion cash required. What happens then?

BTW - SIMO reports after the close today. If I were you I would sell now, and perhaps buy back tomorrow. One possibility is MXL knows SIMO's Q2 results are going to be a disaster, and that's their reason for cancelling the deal. SIMO did $252m in Q2 2022, if they do $50m in Q2 2023, maybe they're going to say that shows SIMO's revenue decline is worse than the industry's, thus they quit.
