As I said, I would expect no one to make an investment based on the potential for a takeover, I said that the company is firmly placed between two rival factions that have a very strong need to control a space. If either bought the company, it would be great for the shareholders, but I dont think its a real possiblity unless the battle escalates to a much higher level. I do think that ACLY has a tool that is the only good process in a space that they own. While it might not be worth $200 mil., the intrinsic value of owning a lock is definitely woth something. This market is full of companies selling for gigantic multiples, look at Rambus or NTKI. Investors always pay up for franchise value, until the franchise disappears. Its always better to short into a disappearing franchise than into an active one, even if the stock has started to breakdown. If its going to go to zero, the percentage gain is always 100% so shorting into the downtrend feels a whole lot better, and less costly, than swimming upstream.
