VIVUS got upgraded at Zacks to a hold:

VVUS 12.5625 0.1250 849400 3 +

Zacks likely raised the rating because some house raised VVUS last night/this morning and has only informed in house clients as of yet. In my experience, ZACKS changes usually proceed movements in the price of VVUS. In this case expect an upgrade soon.

Sorry, i think you're absolutely wrong here.

Its the doctor's legal, moral, and ethical responsibility to give safe treatment to a patient based on their systemic medical history, and the problem they present with at the time of the exam.

I believe most doctors will look at patients with hypertension and diabetes, not to mention other systemic problems, such as pulmonary and renal disease, for example, and will be very hesitant to prescribe a systemic drug. Regardless of what the labelled contraindications or PFE says about their product.
