My optimistic prediction:

VVUS will move up to the 30's before the summer...and these lawyers will be left high and dry.

They must suspect VVUS will want to settle quickly and they'll make some fast $$. Vultures always start circling when they think the victim is weak. We'll soon see whether VVUS' stock price indicates the company is in actual trouble, or Wall St. has it all wrong. I know back in May, Wall St. clearly had it wrong when it took VVUS down to 15 even after an earnings blow-out. Maybe VVUS will be able to shake off the suit by going up in price, and avoiding litigation altogether.
Current holders of Vivus will find that they'll hurt the company and themselves much more by participating in this pointless litigation, than the paltry sum these lawyers might get them. I don't know why this shareholder didn't go first to the SEC if he thought that some officers engaged in illegal insider trading. I guess these lawyers wouldn't get their third that way, and that's what the whole suit is about.
