Subject: Stage Three Transition


Stage Three Transition

Beginning in Round 30, on Tuesday, March 3, at 9:00 am the FCC
will transition the LMDS Auction to Stage III.

To maintain current eligibility in Stage III, a bidder must be
active on at least ninety-eight percent (98%) of the bidding
units for which it is eligible in the current round (its maximum
eligibility).

In Round 30 all bidders should check their activity to determine
whether their current standing high bids are sufficient to
maintain eligibility in Stage III. Bidders are reminded that
they should review the Public Notice titled, "Auction of Local
Multipoint Distribution Service," released on September 25, 1997.
Specifically, pages 16 and 17 which explain auction stages, stage
transitions, and activity requirements.

In Round 30, a bidder can check whether its current activity
satisfies its required activity level in Stage III using the FCC
Remote Bidding System software. The system will reflect whether a
bidder's current activity is sufficient to satisfy its required
activity level for the current round. If the bidding units
associated with a bidder's standing high bids do not satisfy its
required activity level and that bidder does not either bid on
additional licenses to bring its activity up to the required
level or reduce its eligibility before the close of the round,
the FCC will enter an automatic waiver on the bidder's behalf (if
the bidder has waivers remaining). An automatic waiver will
preserve the bidder's maximum eligibility, despite the fact that
it has not met the minimum activity requirement for the round.
In the event that a bidder has no waivers remaining and it does
not satisfy the required activity level, their maximum
eligibility will be permanently reduced based on their activity
in the round to bring them into compliance with the activity
rule.

If a bidder does not plan to bid in the current round and does
not want to use an automatic waiver the bidder must intentionally
reduce its eligibility by using the "Reduce Eligibility" function on
the Options screen. Use of the "Reduce Eligibility" function will
permanently reduce the bidder's eligibility to bring the bidder into
compliance with the activity rule based on the bidder's current
activity. During Stage III, if activity is below the required
minimum level, eligibility in the next round will be calculated by
multiplying the current round activity by
fifty/forty-ninths (50/49).

WTC, I agree with your thesis. I am not really familiar with Bosche Telecom,but I think NT will be the dominant player here. LU is up in the air to me,they have lots of talent,but I am not impressed with their delivery to market of products. CIEN is still ahead of them in DWDM,though LU said over a year ago,they would be far ahead.
NT is the company to beat.

To confirm your assessment, last week Telephony Magazine had
a short article explaining why HP sold its LMDS business to
LU. Roughly speaking, HP felt it had gone as far as it could
by relying on its strength in microwaves component design. The
next step is system integration, for which LU is better
positioned.
