The "white paper" was a good piece of work. I hope you can "redeem" some of its value by reviewing it with the CEO. You might find him agreeing with you. You're not planning to skip the annual meeting, are you?

<The lawsuit isn't about getting "compensation and restitution" for the prior shareholders. The lawsuit, "if" it goes anywhere is about getting the company to restate their earnings for a good long period. Say, like early 96' (perhaps even late 95') through present..

If they have to do that, and it all comes out clean, then I personally will applaud all of Eric Schmidt's efforts to turn this company around, and the BOD becomes a "moot point", no?

If that happens and it "doesn't" come out clean, a lot of people that have (and probably will) continue to invest on the momentum (if in fact it is only momentum, and not a "true upturn" (I am skeptical that it is), will lose a lot of money.... A "lot" of money.>

I'm having a hard time figuring out what's going on with the price right now. Maybe I'm missing something but I'm reading the suit the same way you are. The probability that the suit will result in a SEC investigation and an audit seems rather high to me. The probability that an audit will result in earnings and possibly assets being restated way down also seems rather high IMO. Somehow it strikes me like buying Informx @ 24 knowing an audit was around the corner. Am I out of my mind for being as bearish toward Novell as I am or is everyone crazy except you and me?
