It is called Instinet. If you have some money, say 3-5 million and trade several hundred thousand shares a year, you can have one too.
And the great part is that it does not reall cost much.

If MM's refers to market makers, Yes, they may be active in after hours. They want to show profits too.

As for why is it allowed, In truth, it enables Market Makers to better judge where to open a stock the next day.
Weather it existed or not, the price equliberimum would be found before the market opened tomarrod regardless.
In this case, Instinet or not, the stock will/ should still gap down.
