Dear Jas: Good to see your post.

I recall the statement at WallStreetForum to the effect that IBM has contractually committed to ship a specified number of systems with the WaveMeter inside.

I also recall the statement in the conference call of December 18 to the effect that IBM's commitment is not legally enforceable.

I reconcile these seemingly inconsistent propositions by giving harmonious meaning to each. I conclude that IBM has agreed in writing to apply its best efforts to achieve specific numbers.
