Holly, my initial reaction to this imbroglio was one of disbelief, I thought I was being set up to take the spears of invective while Janice was serenely sunning herself on the Cote d'Azur, laughing at the effect her absence and minions were having.

I was wrong about that latter part of the set up, she apparently has indeed been sanctioned. But the first part did happen, I was cast by some as a heavy in a play I had absolutely no part in.

>>This is not the first instance of unilateral silencing and/or deletion of posts here at SI. For the record, this current fracas extends beyond CGB and Janice. There are other people involved.

I have detailed my part in alerting Jill to Surething's fabricated post. If you are referring to that, then I reject that that is an issue of free speech, rather that was an issue of exposing and removing a blatant lie. As I said before I have no problem with anyone stating what they think. It is, however a far, far different proposition for someone to post a fabricated message purporting to be from me and purporting to state what I think.

I hope that you recognize and appreciate the distinction.

I have dealt with incendiary types at SI once before. You see I had warned someone against shorting Disney sometime around last May and by December he was "losing it". So he threatened me by email, then turned me in to Jill and then threatened me again by email. My only recourse was to advise Jill about what really happened and to post his threats.

The downside: his "friend" bombed my email account so it became useless.

>>It is a case of a gag order being placed on one faction but not on the other.

Is that really true? That is not what I have been told. I was told that both Janice and Christine were told by SI not to post to each other or to refer to each other in public posts. It has been revealed that Janice breached that agreement. I would expect and assume that had Christine done the same that she would be the one in temporary exile.

>>Although privately owned, SI is a public forum, and the SEC has so ruled.

That is complicated business. I suspect that the SEC has ruled that SI is a public forum in its determination of whether it can extend regulation of speech by the government (SEC) that would otherwise violate the First Amendment. That does not mean SI, which afterall contracts with and limits posting to paying members, cannot pull the plug on anyone, especially with adequate warning and with cause.

You may be interested in the following course that I will be taking that may touch on pertinent issues. Maybe you will join me:

Congratulations!

Your application to the cybercourse on "Privacy in Cyberspace," being offered bythe Berkman Center for Internet & Society at Harvard Law School, has been accepted. Please visit cyber.harvard.edu to find
out how to secure your place. (Please do not respond to this email message.)

In the meantime, here are a few more details about the course:

The course is a free, not-for-credit, experimental project of the Berkman Center. It will capitalize on the varied expertise and experience of its participants, who will be expected to do weekly reading assignments, post messages in course discussion groups, and participate in live online dialogues with Professor Miller.

The live sessions will be held approximately once a week, beginning on March 12. Most sessions will be held either on Thursday from 6:00 pm - 7:00 pm, Eastern Standard Time, or on Friday from 2:00 - 3:00 pm, Eastern Standard Time. For those students who cannot participate at these times, transcripts of the live sessions will be archived on the course web site.

We look forward to learning from you in cyberspace!

Sincerely,

Professor Miller and the cybercourse staff

>>For further information and proposed remedies that would work well for everyone in the future, please see the new Warning thread in the Coffee Shop area here at SI.

I've read most of those posts and declined to respond although some were clearly aimed at me for acts I did not commit.

>>Now, please tell us, if you will, would you be saying that "she hanged herself" if it were someone else with whom you are friendly?

To be consistent, I would have to say that if Christine or anyone else who is a party to such agreement had violated that agreement, then she too "hanged" herself.

But is it not true that the sanction is temporary and that she will soon return? I understand that Janice and Christine have many friends in common, so maybe they can patch things up.

Perhaps you have an answer to the following question that many have posed to me: Why did Surething change his moniker to purething?

Many thanks, Holly, and thanks also to all of you who defended me in my absence.

And especially to Betty, who's lent me the tiara for the day... Still stumbling a little without the glasses, but getting the hang of it...
