the issue isn't one of legality, but rather one of enforcement. the shorting in financing of this type is typically done by offshore groups(that's how they can short, ref. yahoo 393). they really don't care about future performance of the stock, they make it on the shorting. I WANT TO BE CLEAR I AM NOT SAYING THAT THIS IS THE CASE WITH WAVX. another example would be ATEG. in this case mngmt. halted the conversion.(see news 2/5/98). my only desire is to wave a warning flag so that we may inquire as to details of financing. I AM STILL VERY LONG ON THE COMPANY and the concept. i do feel somewhat comforted by the fact that with the current price there is little to be gained on the short side.
