Microsoft Judge Recuses Himself techweb.com

But before anyone gets too excited, it ain't Jackson.

U.S. Circuit Judge Laurence Silberman recused himself from the three-judge panel scheduled to hear the Microsoft appeal. The reason for the recusal was not readily available, though sources close to the case said it appears to be a favorable move in light of the Justice Department. . . .

Silberman, a conservative Republican appointed by President Reagan, was replaced Tuesday on the panel by Patricia Wald, a liberal Democrat appointed by former President Jimmy Carter.


Oh my gosh, a diverse leftist liberal commie on the appeals panel. Good thing Orrin Hatch wasn't running the Senate Judiciary committee when she was appointed. Not that I would call this big news, but at least Silberman won't have the chance to let the serial killer walk again, as Harvey Allen would say. Still got that Bork protege on the panel, though, so I assume Bill's ok for the time being.

Looks like the Justice Dept. will have to decide if Java is a programming language or operating environment . Either ways, it end up confusing people all the more because if Java is considered a language, then every tools vendor has the right to adopt it to their respective frameworks (AFC, WFC, Swing) and if it is considered an operating environment, then what's the DOJ doing siding with a potential competitor of MSFT !

Quixotic times ahead.
