Three thoughts to add to the preceding posts.

1. Most of my shorts are NYSE, and Datek seems often to be the only broker who can short some of there. (maybe they don't really borrow it at all, and just book it to earn the interest income - that's just wild negative speculation on my part).

2. It's possible that Jon Normile got it wrong. Clearly, they MUST adhere to their original documentation as amended - and I have received no notice of amendment.

3. Two months ago my state security commission did look up Datek at my request in the combined database of broker violations (the name of which I've forgotten) and came up with only a technical Florida violation.
