Gee, where are all the lawyers when the lawyerly types of questions are asked? I guess they all went to dinner, at least the ones on the East Coast, so I'll take a shot at this.

Assault in it's purest sense means to threaten or menace. Should the assault progress to touching, then you have the battery part of assault and battery. Of course, there are many types of assaults. This curbstone definition covers the "touching" question.

I'm sure the East Coast lawyers will be back with better answers after they have had dinner.

You are quite wrong, her testimony is that he did touch her. If her account of the events is true, I can assure you had I been her, I would have immediately reported his assault. But not that it any longer matters, I'm sure in today's environment I would be told that I asked for it, and that it was only "boorish" behavior, and remember going forward that the new standard is the one grope rule, so get used to it... <g>
